Mangion, 27, still faces second-degree murder and eight other detective counts related to Thompson’s death in December.
Judge Gregory Caro found that the prosecutors had not presented sufficient evidence to the large ju court that Mangion acted with the intention of intimidating health insurance workers or affecting government policies.
“There is no doubt that the crimes issued here are not ordinary ‘street crimes’, but they do not follow the intention of all non-street crimes being included out of reach of terrorism law,” Karo wrote in his decision.
Mangione was handcuffed at the bottom of Manhattan, and led to court in Tan’s prison clothes and bondage to his feet.
The judge set the date for Mangion’s next court in the December 1st case – nearly a year after Thompson’s death. Thompson was murdered outside a hotel in midtown Manhattan on December 4, 2024, where his company was holding an investor meeting.
Mangion still faces serious penalties in lawsuits against him, including living in prison if he is ultimately convicted of murder in his second degree.
He is also facing another federal charge regarding the murder of Thompson, former CEO of Insurance Unity UnitedHealthcare at UnitedHealth Group. Mangion pleaded not guilty to both state and federal charges.
Mangion faces seven counts of criminal possession of weapons possessing false identifications in a state case against him.
A spokesman for Manhattan District Attorney Alvin Bragg said in a statement:
The US Department of Justice is calling for the death penalty for a federal incident against Mangion. The terrorism number Karo’s firing at the state level is not related to federal lawsuits.
Sudden health care costs
Thompson’s murder was also widely condemned by civil servants across the political spectrum, but Mangion has become a folk hero for some Americans who denounce sudden medical expenses.
On Wednesday morning, a small group of Mangion supporters gathered outside the courthouse. One was wearing a green costume from Nintendo character Luigi, and the other embraced a red, white and green tricolor engraved on the flag with the words “Healthcare is human rights.”
Around 20 members of the masses (mostly young women) secured seats behind the courtroom and watched the lawsuit. She wore a black T-shirt with the words “Friruigi” written in white.
The trial date has not yet been set in either state or federal cases. Mangion has served in federal custody in Brooklyn since his arrest last year.
