WASHINGTON (AP) — The Trump administration on Friday asked the Supreme Court to suspend a judge’s order that would allow transgender and non-binary people to choose sex markers on their passports.
Court Order Transgender or non-binary people can request male, female, or “X” identification markers rather than limited to markers that match the gender of their birth certificates.
The Justice Department argues that there is no need to use sexual designations the government considers to be inaccurate in official documents.
The order comes after a lawsuit challenging an executive order from President Donald Trump, requiring people to choose “male” or “female” based on birth certificate designation.
The plaintiffs said that some transgender people are afraid that their applications will be returned with changes to their designation and that others will submit applications.
